Suit Against Mombasa County Government

The county government of Mombasa issued directives that all commercial and residential buildings in the Central Business District be painted white and Egyptian Blue. Best Lady Cosmetics was unwilling to follow this directive. The company is distinctive with their bright pink colors hence they felt painting it blue and white is infringing on their identity.

They moved to court seeking to prevent the county government from forcefully painting their shops. The cosmetics company said that governor Ali Hassan Joho had no right to issue such a directive, it lacked backing from the constitution.

“The implementation will deny us the right to use our long-term trademarks and branding, which would inevitably lead to loss of customers and business earnings,” read an affidavit by Peter Njoroge Karanja.

Following the law suit, Mombasa high court judge Eric barred the county government from interfering with Best Lady’s color.
