Billionaire loses Ksh 10B Land in Fight With Joho

Tycoon Francis Mburu, a businessman in Nairobi lost a parcel of land worth Ksh 10 Billion in a case against him, Aftraco Limited, which is associated with Mombasa Governor Hassan Joho and the Kenya Posts and Telecommunication Corporation (KPTC}.

The judge ruled on April 22 that an arbitrator made a mistake in granting the parcel to Exclusive Estates Limited (EEL), a company owned by tycoon Francis Mburu. The disputed land is located in Nairobi’s Jamhuri Estate on Ngong Road.

The arbitrator in question, lawyer Zehrabum Janmohamed had granted Mburu the land on the basis of having a contract with KPTC where the land was to be developed years ago, hence making him the rightful owner of the land.   

On the other hand, Governor Joho pleaded his case by explaining that he had paid KPTC deposit to secure the land.

The land was to appreciate in value and be sold at Ksh 1.52 billion in 2011 hence making him the rightful owner. The lawyer Janmohamed, however, faulted the sale between KPTC and Aftraco. 

Tables turned on Mburu after he went to explain his side of the story and the judge clarified that he had been awarded land which he had not bought. The agreement between Mburu and KPTC was therefore null and void. 

Several land cases had emerged previously which linked Mburu as the mastermind. One of them being the sale of land in Ruaraka to the government which was worth Ksh3.2 billion. 

The case was handed over to the office of the Director of Public Prosecution after the Ethics and Anti-Corruption Commission concluded investigations in 2018. 

A modern sports complex is currently being constructed by the government in the mentioned land.

The construction commenced after the Ministry of Sports and Environment signed a contract that would make it easy to utilize and manage the Jamhuri Sports Ground. 

This is one of the initiatives President Uhuru Kenyatta launched to enhance and grow talent and sporting activities in the country. 

Sports CS Ambassador Amina Mohamed had said in an event in January 2021 that the government’s aim is to see to it that the Jamhuri Sports Complex is completed on time.

The plan will enable the Sports Ministry to increase the number of sports training and competition facilities in the nation. 

The modern complex under construction is meant to have one rugby pitch, an athletics track, three football pitches, and hockey fields. This will come in handy in ensuring youths engage in sporting activities a lot,
